Liability Waiver & Release (Mississippi Law)

By attending the Sunflower River Blues and Gospel Festival, you voluntarily assume all risks associated with participation in the event and hereby agree to release, waive, discharge, and hold harmless the festival organizers, sponsors, volunteers, staff, partners, the City of Clarksdale (if applicable), and all affiliated entities (collectively, the “Released Parties”) from any and all liability.

This waiver and release applies to any and all claims, demands, causes of action, damages, losses, or expenses of any kind, whether arising from negligence or otherwise, to the fullest extent permitted by the laws of the State of Mississippi.

This includes, but is not limited to:
  • Personal injury, illness, or death
  • Property loss, theft, or damage
  • Accidents or incidents occurring on or around festival grounds
By attending, you acknowledge that:
  • You are physically and mentally capable of participating in festival activities
  • You fully understand the risks involved, including those associated with large public gatherings and outdoor environments
  • You freely and voluntarily accept all risks, both known and unknown

You further agree not to file any claim or lawsuit against the Released Parties for any injury, loss, or damage sustained in connection with your attendance or participation.

If any portion of this waiver is found to be invalid under Mississippi law, the remaining provisions shall continue in full force and effect.

Health & Safety / COVID-19 Policy (Mississippi Compliance)

The Sunflower River Blues and Gospel Festival is committed to maintaining a safe environment in accordance with applicable public health guidance.

By attending the festival, you acknowledge and agree:

  • You will comply with any local, state, or federal health regulations, including those issued by the Mississippi State Department of Health
  • You will not attend if you are experiencing symptoms of illness, including fever, cough, or other contagious conditions
  • You understand that attendance at a public event may increase your risk of exposure to illnesses, including COVID-19

The festival makes no guarantees regarding protection from illness.

Health and safety measures may be implemented in accordance with guidance from:
  • The Mississippi State Department of Health (MSDH)
  • Local authorities in Clarksdale, Mississippi
  • Federal public health agencies, if applicable

Such measures may include, but are not limited to:

  • Sanitization stations
  • Crowd management practices
  • Public health advisories

By attending, you agree to follow all posted health and safety guidelines and understand that failure to comply may result in removal from the event.

Governing Law & Venue

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms & Conditions or participation in the Sunflower River Blues and Gospel Festival shall be resolved exclusively in the appropriate state or local courts located in Coahoma County, Mississippi.

By attending the festival or using this website, you consent to the jurisdiction and venue of such courts.

Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or related to:

  • Your attendance at or participation in the festival
  • Your violation of these Terms & Conditions
  • Your actions or conduct during the event
